Agreement

The signing student agrees to accept the following terms and conditions for the theororetical knowledge course.

Course Fees

Course fees are payable by invoice. The invoice will be issued upon registration for the course and must be paid in full by the deadline indicated.

Please note that your registration becomes binding only once the full course fee has been received. If payment is not made within the specified deadline, we reserve the right to cancel your registration or deny access to the course until the outstanding amount is settled.

In case of late payment, the applicable legal provisions will apply, and reminder fees may be incurred.

Confidentiality

All access data provided for the course or training (e.g., username, password, access codes) is confidential and must not be shared with third parties. The student is responsible for keeping this data secure and protecting it from unauthorized access.

Access data is for personal use only and must not be transferred to others. Unauthorized use by third parties is a violation of the terms and conditions, which may result in immediate access suspension and, if necessary, termination of course participation.

If misuse of access data is suspected, the participant must notify SwissPSA immediately to allow for appropriate security measures. SwissPSA reserves the right to block access or take legal action if these obligations are violated.

Course Material

The course materials mainly consist of e-books, which will be provided to the student for the duration of the course. These e-books are for personal use only, within the context of the course.

Access to the e-books is valid only during the course. Once the course is completed, access is automatically deactivated, and the student will no longer have access.

Downloading, copying, forwarding, or any other use of the e-books outside the course is prohibited and constitutes a violation of copyright law.

SwissPSA reserves the right to block access to the e-books at any time if these terms are violated. SwissPSA does not guarantee the absence of errors nor does it take responsibility for the content.

Technical Requirements

If an e-learning account is created to complete the theoretical knowledge course, users must have basic computer skills, a stable internet connection, and a valid email address. SwissPSA will make every reasonable effort to ensure uninterrupted access to the e-learning platform. However, the platform's maintenance and operation are managed by third parties on behalf of SwissPSA.

As an internet-based service, the e-learning platform is generally compatible with common operating systems. SwissPSA does not assume responsibility for internet access issues, the functionality of learning aids provided through the platform, or the automatic evaluation of online tests. Additionally, SwissPSA is not liable for any incompatibilities between a student's hardware or software and the e-learning platform. Since performance may vary across different browser versions, the use of a current internet browser is strongly recommended.

Course Duration

Access remains valid until the FOCA theoretical exam is completed, but for a maximum of one year. After this period, the training agreement expires, and the student must re-enroll and pay an extension fee of CHF 150 to continue the course. Any extension of the course duration is only possible within the legally prescribed deadlines.

Course Attendance

The student commits to fully attending the course without any gaps, in accordance with legal guidelines (Training Record). This applies to both classroom lessons and Distance Learning Seminars. All lessons, self-study sessions, and seminars organized by the flight school are integral components of the course.

Progress Monitoring

Progress is monitored through tests conducted via the e-learning platform or in-class assessments. If a student does not achieve the required minimum score to pass, they must retake the test after further studying the material. Instructors are available via email, online forum, or chat to address any questions or uncertainties.

If knowledge gaps are identified, the student agrees to follow the measures implemented by the instructor to address them. Assigned tasks must be completed fully and on time. If these measures do not lead to the desired progress, additional steps can be arranged in consultation with the student and the Chief Theoretical Knowledge Instructor (CTKI). This may include private tutoring with an instructor. Any costs associated with such additional support will be borne by the student.

Classroom Instruction

A student may only participate in classroom instruction after fully studying all course materials and successfully completing all tests on the e-learning platform. Once all tests have been completed, the student must immediately inform the CTKI (course administrator) to receive registration for the classroom instruction.

Classroom instruction takes place according to the course schedule. It is considered completed when the student has attended at least 90% of the total instruction time. If a student attends less than 90%, the missed instruction must be made up at a later date. If the instruction is made up outside the regular course schedule, the student will incur additional costs.

Registration for online classroom instruction is done via the e-learning platform TalentLMS and must be completed by the deadline specified on the provider’s homepage.

Registration for classroom instruction is possible no earlier than four weeks before the scheduled course start date.

Classroom instruction usually takes place in February and September.

Theoretical examination

SwissPSA's internal final exam will be conducted after the completion of classroom instruction. The student acknowledges that they will not be admitted to the Federal Office of Civil Aviation theoretical examination until they have successfully passed the final exam. A passing score requires at least 75% correct answers. If the final exam is taken outside the regular scheduled dates due to scheduling reasons, the student will be responsible for any additional costs incurred.

Disagreements

If a student disagrees with or is dissatisfied with a decision or procedure of an instructor, they may contact the Chief Theoretical Knowledge Instructor (CTKI) of SwissPSA. The CTKI will review the matter and determine the appropriate course of action in consultation with the instructor.

Course termination

If a student withdraws from the course, they are not entitled to a refund of the course fees. The cancellation must be submitted in writing to the Chief Theoretical Knowledge Instructor of the flight school at ctki@swisspsa.ch.

Liability

The place of jurisdiction for any disputes arising from these terms and conditions shall be the registered office of SwissPSA.

Swiss law shall apply.
